These Terms of Service (“Terms”) govern your use of Protech OS, provided by PROTECH OS LTD (company number 17110868, registered in England & Wales at 3 Hury Way, Darlington, United Kingdom, DL2 2XF) (“Protech OS”, “we”, “us”). By creating an account or using the platform you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it.

1. What Protech OS is

Protech OS is a documentation tool that helps competent health & safety professionals draft, assemble and manage H&S documents more quickly, using artificial intelligence to produce draft content from information you provide. It is not a health & safety consultancy, is not a “competent person”, and does not provide legal, safety or professional advice. It expedites the writing process; it does not replace professional judgement, site assessment, or your legal duties.

2. AI-generated content and your responsibility

2.1 AI can make mistakes. Content generated by the platform may be incomplete, inaccurate, out of date, or unsuitable for your specific site, task or circumstances. It may misinterpret documents you upload, omit relevant matters, or produce plausible-but-incorrect content, including mis-stated references to legislation, standards or guidance. We cross-check legislation citations but do not warrant their accuracy.

2.2 All output is a draft. Every document produced using Protech OS must be reviewed, edited as necessary, and approved by a competent person (within the meaning of the Management of Health and Safety at Work Regulations 1999 and, where applicable, CDM 2015) before it is issued, relied upon, briefed or used on site.

2.3 Approval is your confirmation. Marking a document “Approved” in the platform constitutes confirmation by a competent person within your organisation that they have reviewed it, that it is suitable and sufficient, and that your organisation accepts responsibility for it.

2.4 You remain responsible. You and your organisation retain full and sole responsibility for the accuracy, suitability and legal compliance of every document produced using the platform, and for health & safety on your projects. Nothing produced by Protech OS transfers any of that responsibility to us.

3. Accounts and eligibility

You must provide accurate registration details, keep your credentials secure, and are responsible for activity under your account. You must be 18 or over and using the platform in the course of a business or profession.

4. Acceptable use

You agree not to: use the platform unlawfully or to produce documents you know to be false or unsafe; upload material you have no right to upload or that contains another party’s confidential information without authority; attempt to breach security, access other organisations’ data, or circumvent tenant isolation; reverse engineer, scrape or resell the platform; or upload malware. We may suspend accounts that breach this section.

5. Your data and data protection

For personal data within your account and documents, you are the data controller and we act as your data processor; our processing is described in our Privacy policy. Your primary data is hosted in the EU, encrypted in transit and at rest. To generate documents, content you provide is sent to our AI sub-processor (Google) for processing. Uploaded source files are automatically deleted after a 30-day retention window once used. You may export or permanently delete your organisation’s data at any time.

6. Confidentiality and security

We apply appropriate technical and organisational measures to protect your data, including database-level tenant isolation, encryption, access controls and audit logging. No system is perfectly secure; you are responsible for keeping your credentials safe.

7. Intellectual property

You retain ownership of the information you provide and of the documents generated for you, subject to payment of any fees, and grant us the limited licence needed to host and process that content to provide the service. We retain all rights in the Protech OS platform, software, templates and underlying systems, and grant you a non-exclusive, non-transferable right to use it for your business.

8. Service availability; no warranty

The platform is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties that the platform or any output will be uninterrupted, error-free, accurate, complete, compliant, or fit for a particular purpose.

9. Limitation of liability

9.1 Nothing in these Terms limits liability that cannot be limited by law (including death or personal injury caused by negligence, or fraud).

9.2 Subject to 9.1, and given that you are responsible for reviewing and approving all documents through a competent person, we are not liable for: losses arising from your reliance on un-reviewed or improperly reviewed output; inaccuracies in AI-generated content; or any health & safety incident, loss, fine or claim arising from documents used on your projects.

9.3 Subject to 9.1, our total aggregate liability arising out of or in connection with the service is limited to the total fees you paid in the 12 months before the claim.

9.4 We are not liable for indirect or consequential loss, or loss of profit, revenue, goodwill or data.

10. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms, your misuse of the platform, or documents you produced and used in breach of section 2.

11. Term, suspension and termination

You may stop using the platform at any time. We may suspend or terminate access for breach of these Terms or non-payment. On termination you may export your data for 30 days, after which we may delete it.

12. Changes

We may update these Terms; material changes will be notified by email or in-app. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
